1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Puterize ("Company", "we", "us", or "our") governing your access to and use of the Euclid's Elements interactive educational platform ("Service"). By accessing, browsing, registering for, or otherwise using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease all use of the Service.

These Terms apply to all Users of the Service, including without limitation visitors, registered Users, and Users who access or use the Service on a free or paid basis.

2. Description of Service

Euclid's Elements is an interactive educational platform provided by Puterize that allows Users to explore and learn geometric propositions through interactive constructions using compass and straightedge tools. The Service includes all features, content, functionality, and any updates or modifications thereto.

3. Educational Purpose

The content provided through this Service is for educational purposes only. While Puterize strives for accuracy in representing Euclid's original propositions, Users should verify critical information with additional scholarly sources. The Service does not constitute formal academic instruction or certification.

4. Service Tiers and User Classification

4.1 Free Tier Users

Users who access and use the Service without a paid subscription ("Free Tier Users") are entitled to use the features available within the free tier as designated by Puterize. Free Tier Users acknowledge and agree that the Service is provided entirely free of charge and without any guarantee of service availability, performance, or fitness for any particular purpose.

4.2 Paid Tier Users

Users who subscribe to a paid plan ("Paid Tier Users") are entitled to the additional features and service levels specified in their subscription agreement. Paid Tier Users are subject to additional terms specific to their subscription plan, which are incorporated herein by reference.

5. "As Is" Disclaimer and Warranty Exclusion

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PUTERIZE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT:

  • You assume all risk associated with your use of the Service, including but not limited to any reliance on the accuracy, completeness, or usefulness of any content available through the Service.
  • Puterize does not warrant that any errors or defects in the Service will be corrected, or that the Service will meet your requirements.
  • Any content obtained through the use of the Service is obtained at your own risk, and you shall be solely responsible for any damage to your computer system, mobile device, or data that results from such use.
  • No advice or information, whether oral or written, obtained from Puterize or through the Service shall create any warranty not expressly stated in these Terms.

6. Limitation of Liability

6.1 Complete Exclusion of Liability for Free Tier Users

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOR FREE TIER USERS: PUTERIZE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL HAVE ZERO LIABILITY WHATSOEVER FOR ANY CLAIM, DAMAGE, OR LOSS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, use, goodwill, or other intangible losses.
  • Any errors, mistakes, inaccuracies, or omissions in any content available on the Service.
  • Any personal injury, property damage, or any nature whatsoever resulting from your access to and use of the Service.
  • Any unauthorized access to or use of our servers, systems, or any personal information stored therein.
  • Any interruption, suspension, or cessation of transmission to or from the Service.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.
  • Any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Service.
  • Deletion of, corruption of, or failure to store any content or communications data maintained or transmitted by or through your use of the Service.

This complete exclusion of liability applies regardless of the legal theory upon which the claim is based, whether in contract, tort (including negligence), strict liability, product liability, or otherwise, and even if Puterize has been advised of the possibility of such damages.

6.2 Limitation for Paid Tier Users

FOR PAID TIER USERS: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PUTERIZE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO PUTERIZE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (EUR 100). THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF ANY EXCLUSIVE OR LIMITED REMEDY PROVIDED HEREIN.

IN NO EVENT SHALL PUTERIZE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, EVEN IF PUTERIZE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and identification
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are solely responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. Puterize shall not be liable for any loss or damage arising from your failure to comply with this section.

8. User Content

You retain all rights to the content you create on the Service, including interactive constructions and progress data. By using the Service, you grant Puterize a non-exclusive, worldwide, royalty-free license to host, store, and display your content solely for the purpose of providing the Service.

Puterize does not claim ownership of your user-generated content. You are solely responsible for your content and agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Upload or transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to the Service or its related systems

9. Intellectual Property

Euclid's Elements was written around 300 BC and is in the public domain. The interactive constructions, software, algorithms, user interface, and additional content created for this Service are owned by Puterize and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have Puterize's written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices. By using the Service, you consent to the collection, use, and disclosure of information as described in our Privacy Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless Puterize, its directors, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or (d) any claim that your content caused damage to a third party.

12. Termination

Puterize may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Force Majeure

Puterize shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond Puterize's reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, quarantine restrictions, strikes, shortages of transportation, fuel, energy, labor, or materials, failures of telecommunications or information systems, or any other force majeure event.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the Netherlands. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published by Puterize on the Service, constitute the entire agreement between you and Puterize concerning the Service. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Puterize regarding the Service.

17. Changes to Terms

Puterize reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, Puterize will provide at least thirty (30) days' notice prior to any new terms taking effect by posting a notice on the Service. What constitutes a material change will be determined at Puterize's sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, you must stop using the Service.
